It's all too common that a title or real estate issue that requires a fairly simple solution slows down, or even stalls, a project because of the time it takes to fully understand the issue, and most planning law courses teach only land use cases, as opposed to fundamentals of real estate and property law. By increasing their knowledge base in the world of real estate law, planners can better arm themselves to navigate these issues as they arise, which will increase efficiency and equity in the planning process.

Learning Objectives:

  • Share a baseline understanding of various concepts of real estate law that impact planners on a daily basis, such as possessory interests, deeds, covenants, and other private restrictions
  • Understand how the planning and entitlement approval process fits into the timing and contingencies of a typical real estate transaction
  • How to effectively navigate title issues that arise in the context of the planning and entitlement process (e.g., lenders, common owners, etc.)
